Sexual Gender Discrimination



Sexism means treating a person adversely because of the gender (a candidate or employee) (including an individual's sexual orientation, gender, or pregnancy).


Sex Discrimination and Work

The law forbids discrimination in any aspect of employment including employment, dismissal, wages, job distribution, promotion, layoffs, training, fringe benefits and any other terms or conditions of employment.


Sexual Discrimination and Harassment

It is illegal to harass someone because of their gender (including their sexual orientation, gender or pregnancy). Harassment includes "sexual harassment" such as unwelcome sexual assault, demands for sexual favors, and other verbal or physical harassment of a sexual nature. However, harassment is not necessarily sexual harassment, and offensive remarks about a person's gender (including sexual orientation, gender or pregnancy) are also harassment. For example, it is illegal to harass a woman by making offensive comments about her.

The victim and harasser may be of either sex, and the victim and harasser may be of the same sex or the opposite sex.

Although the law does not prohibit minor teasing, casual comments, or uncommon or serious isolated incidents, harassment is illegal if it is frequent or severe, thereby causing hostility or aggression in the work environment, or resulting in adverse employment decisions (e. g., victim dismissal or demotion).

The harasser can be the victim's supervisor, an other supervisor, colleague, subordinate, or someone who is not an employer employee, such as a client or customer.


Gender Discrimination and Employment Principles / Practices

Employment principles or practices applicable to all persons, regardless of gender, may be illegal if they negatively affect the employment of one gender and are unrelated to work or to the operation of a business.
